Terms of Service

Welcome to Bhagavan, an educational app developed by Bhagavan Ltd ("Bhagavan Ltd," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile application ("App"), websites ("Websites"), and related services (together with the App and Websites, the "Services"). By using Bhagavan, you agree to these Terms. If you do not agree, please do not use the Services.

Bhagavan Ltd reserves the right to amend these Terms ("Amended Terms") at any time. We will notify you of material changes at least 14 days before they take effect by sending notice to the email address you last provided or through a notice within the App. If you do not object to the changes within 14 days, the changes shall be deemed accepted. If you object, your Subscription will terminate at the end of the current Subscription Period without automatic renewal.

Bhagavan is designed for all ages. However, to create an account, you must be at least eighteen years of age. If you are at least fourteen years of age, you may create an account with the consent of your legal guardian.

To use Bhagavan, you must create an account with your name and email address. You may also use single sign-on services provided by third parties such as Apple or Google if available. When creating an account, you agree to:

• Provide accurate, complete and current information
• Maintain the confidentiality of your password and account security information
• Notify us immediately of any unauthorised access to your account

You are responsible for all activities that occur under your account. Bhagavan Ltd is not liable for any loss resulting from unauthorised access to your account.

Bhagavan offers automatically renewable subscription plans ("Subscription") at different tiers and periods ("Subscription Period"). Subscriptions enable you to access premium features and content within the App.

Payment will be processed through Apple App Store or Google Play Store, depending on your device. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current Subscription Period. We will notify you of upcoming renewals at least 15 days in advance via email.

You can manage or cancel your subscription through your device's subscription settings. Upon cancellation, you will continue to have access until the end of your current Subscription Period.

Bhagavan Ltd may occasionally offer promotional codes ("Promotional Codes") that provide discounts on Subscriptions. We may also run referral programmes, competitions or contests ("Referral Programmes") that reward users for referring new users or participating in activities.

Promotional Codes and Referral Programmes are subject to the following terms:

• At our sole discretion, we may determine eligibility, suspend or discontinue any Promotional Code or Referral Programme at any time
• Promotional Codes cannot be redeemed for cash, refunded, exchanged or combined with other offers
• Referral rewards may be subject to verification and terms specific to each programme
• We reserve the right to disqualify participants who violate these Terms or engage in fraudulent activity
• Referral Programmes may have expiration dates or limited availability

By participating in any Referral Programme, you agree to comply with all applicable laws and regulations, including but not limited to anti-spam laws and restrictions on automated or fraudulent referrals.

All content, features and functionality of the Services, including but not limited to text, graphics, logos, images, audio, designs, software and their arrangement, are owned by Bhagavan Ltd or our licensors and are protected by copyright, trademark and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Services for your personal, non-commercial use. You may not:

• Copy, reproduce, modify or create derivative works of the Services or any content therein
• Reverse engineer, decompile, disassemble or attempt to derive the source code of the App
• Remove, alter or obscure any copyright, trademark or proprietary notices
• Use the Services for any commercial purpose without our express written consent
• Transfer, sublicense or assign your rights under these Terms

The Services may allow you to create, submit, post or share content such as comments, reviews or other materials ("User Content"). By submitting User Content, you grant Bhagavan Ltd a worldwide, perpetual, irrevocable, non-exclusive, royalty-free licence to use, reproduce, modify, adapt, publish, translate and distribute such User Content for the purpose of providing and promoting the Services.

You represent and warrant that:

• You own or have the necessary rights to the User Content you submit
• Your User Content does not violate any third-party rights, including intellectual property, privacy or publicity rights
• Your User Content is not abusive, harassing, threatening, hateful or otherwise objectionable
• Your User Content does not violate any applicable laws or regulations

We reserve the right to monitor, review and remove any User Content that violates these Terms or is otherwise inappropriate, without prior notice.

You agree not to misuse the Services or engage in any activities that:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Attempt to hack, breach or circumvent any security measures
• Interfere with or disrupt the Services or servers connected to the Services
• Use automated systems, bots or scripts to access the Services without authorisation
• Collect or harvest information about other users without their consent
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

Any violation of this section may result in immediate termination of your account and access to the Services.

By using Bhagavan, you agree that Bhagavan Ltd may collect and process your data as described in our Privacy Policy. We collect usage data via PostHog analytics to improve the Services and store account information securely in Supabase. For detailed information about how we handle your data, please refer to our Privacy Policy.

To the maximum extent permitted by law, Bhagavan Ltd and its affiliates, officers, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data or other intangible losses, resulting from your use of or inability to use the Services.

Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

We do not guarantee that the Services will be uninterrupted, secure or error-free, or that any defects will be corrected. You use the Services at your own risk.

All purchases are processed through Apple App Store or Google Play Store, and refunds are subject to their respective refund policies. If you are eligible for a refund under applicable consumer protection laws, you may request a refund within 14 days of purchase, provided you have not substantially used the Services.

To request a refund, please contact us at hello@bhagavan.io or through the App Store or Google Play Store support channels. Refunds, if approved, will be processed using the same payment method used for the original transaction.

You may terminate your account at any time by deleting it through the App settings or by contacting us at hello@bhagavan.io. Note that deleting your account does not automatically cancel an active Subscription; you must cancel your Subscription separately through your device's subscription settings.

Bhagavan Ltd reserves the right to suspend or terminate your account and access to the Services immediately, without prior notice, if you violate these Terms or engage in fraudulent, harmful or illegal activity. Upon termination, your right to use the Services will cease immediately.

If you have any dispute with Bhagavan Ltd regarding these Terms or the Services, you agree to first contact us at hello@bhagavan.io to attempt to resolve the dispute informally.

If we cannot resolve the dispute within 30 days, you agree that any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. This arbitration will take place in your jurisdiction, and you waive any right to a jury trial.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bhagavan Ltd is incorporated, without regard to its conflict of law provisions. If you are a consumer, you may have rights under the laws of your country of residence that cannot be excluded or limited.

We may update these Terms from time to time to reflect changes in our Services, legal requirements or business practices. Material changes will be communicated to you at least 14 days in advance via email or through a notice within the App. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
