Terms of Service

1. General Provisions

Welcome to Bhagavan, an educational app developed by Bhagavan ("Bhagavan," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our mobile application ("App"), websites ("Websites"), and related services (together with the App and Websites, the "Services"). By using Bhagavan, you agree to these Terms. If you do not agree, please do not use the Services.

Bhagavan reserves the right to amend these Terms ("Amended Terms") at any time. We will notify you of material changes at least 14 days before they take effect by posting a notice within the App or on our Websites. Your continued use of the Services after the Amended Terms take effect constitutes acceptance of them. If you do not agree to the Amended Terms, you should stop using the Services and may cancel any active Subscription through your device's subscription settings.

2. Eligibility and Account Registration

To create an account, you must be at least 13 years of age. If you are under the age of 18 (or the age of majority in your jurisdiction), you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

To use Bhagavan, you must create an account with your name and email address. You may also use single sign-on services provided by third parties such as Apple or Google if available. When creating an account, you agree to:

• Provide accurate, complete, and current information
• Maintain the confidentiality of your password and account security information
• Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account. Bhagavan is not liable for any loss resulting from unauthorized access to your account.

3. Subscriptions and Payments

Bhagavan offers an automatically renewable premium subscription ("Subscription"), which may be offered at different price points or billing periods (each, a "Subscription Period"). A Subscription unlocks access to premium features and content within the App.

Payment is processed through the Apple App Store or Google Play Store, depending on your device, and our subscriptions are managed on our behalf by RevenueCat. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current Subscription Period. Renewal, billing, and any related notices or reminders are handled by the Apple App Store or Google Play Store in accordance with their policies; we do not separately send subscription renewal reminder emails.

You can manage or cancel your subscription through your device's subscription settings. Upon cancellation, you will continue to have access until the end of your current Subscription Period.

4. Promotional Codes and Referral Competitions

Bhagavan may occasionally offer promotional codes ("Promotional Codes") that provide discounts on Subscriptions. We may also run referral programs, competitions, or contests ("Referral Programs") that reward users for referring new users or participating in activities.

Promotional Codes and Referral Programs are subject to the following terms:

• At our sole discretion, we may determine eligibility, suspend, or discontinue any Promotional Code or Referral Program at any time
• Promotional Codes cannot be redeemed for cash, refunded, exchanged, or combined with other offers
• Referral rewards may be subject to verification and terms specific to each program
• We reserve the right to disqualify participants who violate these Terms or engage in fraudulent activity
• Referral Programs may have expiration dates or limited availability

By participating in any Referral Program, you agree to comply with all applicable laws and regulations, including but not limited to anti-spam laws and restrictions on automated or fraudulent referrals.

5. Intellectual Property Rights

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, images, audio, designs, software, and their arrangement, are owned by Bhagavan or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use. You may not:

• Copy, reproduce, modify, or create derivative works of the Services or any content therein
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the Services for any commercial purpose without our express written consent
• Transfer, sublicense, or assign your rights under these Terms

6. User-Generated Content

The Services may allow you to create, submit, post, or share content such as comments, reviews, or other materials ("User Content"). By submitting User Content, you grant Bhagavan a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such User Content for the purpose of providing and promoting the Services.

You represent and warrant that:

• You own or have the necessary rights to the User Content you submit
• Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
• Your User Content is not abusive, harassing, threatening, hateful, or otherwise objectionable
• Your User Content does not violate any applicable laws or regulations

We reserve the right to monitor, review, and remove any User Content that violates these Terms or is otherwise inappropriate, without prior notice.

7. Acceptable Use

You agree not to misuse the Services or engage in any activities that:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Attempt to hack, breach, or circumvent any security measures
• Interfere with or disrupt the Services or servers connected to the Services
• Use automated systems, bots, or scripts to access the Services without authorization
• Collect or harvest information about other users without their consent
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

Any violation of this section may result in immediate termination of your account and access to the Services.

8. Data Usage and Privacy

By using Bhagavan, you agree that Bhagavan may collect and process your data as described in our Privacy Policy. We collect usage data via PostHog analytics to improve the Services and store account information securely in Supabase. For detailed information about how we handle your data, please refer to our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Bhagavan and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Services.

Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected. You use the Services at your own risk.

10. Refunds and Cancellation

All purchases are processed through Apple App Store or Google Play Store, and refunds are subject to their respective refund policies. If you are eligible for a refund under applicable consumer protection laws, you may request a refund within 14 days of purchase, provided you have not substantially used the Services.

To request a refund, please contact us at hello@bhagavan.io or through the App Store or Google Play Store support channels. Refunds, if approved, will be processed using the same payment method used for the original transaction.

11. Termination

You may terminate your account at any time by deleting it through the App settings or by contacting us at hello@bhagavan.io. Note that deleting your account does not automatically cancel an active Subscription; you must cancel your Subscription separately through your device's subscription settings.

Bhagavan reserves the right to suspend or terminate your account and access to the Services immediately, without prior notice, if you violate these Terms or engage in fraudulent, harmful, or illegal activity. Upon termination, your right to use the Services will cease immediately.

12. Dispute Resolution

If you have any dispute with Bhagavan regarding these Terms or the Services, you agree to first contact us at hello@bhagavan.io to attempt to resolve the dispute informally.

If we cannot resolve the dispute within 30 days, you agree that any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. This arbitration will take place in your jurisdiction, and you waive any right to a jury trial.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bhagavan is incorporated, without regard to its conflict of law provisions. If you are a consumer, you may have rights under the laws of your country of residence that cannot be excluded or limited.

14. Changes to the Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. Material changes will be communicated at least 14 days in advance through a notice within the App or on our Websites. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
